The Declaration of Rights enshrined in the Zimbabwean constitution provides for protection from slavery and forced labour.
Very limited exceptions are provided, principally in relation to labour required as a result of a court sentence, or by way of parental discipline.
Can a person be forced to stay in a job?
In terms of Part II of the Labour Act as read together with the Declaration of Rights in the Constitution, an employee is entitled to be protected from forced labour.
Can their passport or ID be taken away to make sure they stay in their job?
In terms of Part II of the Labour Act as read together with the Declaration of Rights in the Constitution, an employee shall be protected from inhumane and degrading treatment and enjoy his or her right to personal liberty.
Further an employer has a duty to adhere to fair labour standards including the duty not to hinder or prevent any employee from or penalising him/her for seeking access to any lawful proceedings in order to advance his or her interests.
